22.4 ‘’Force Maure’’ shall mean (i)

22.4 ‘’Force Maure’’ shall mean (i) the outage or failure of any satellite or transponder (expect as a result of sun outages), (ii) the outage or failure of any other equipment owned or maintained by any person other than HBOPP of its affiliates (iii) the inability of any person, after reasonable efforts, to obtain or procure, or the withdrawal by any governmental authority of any permit, license, approval or clearance of or from any governmental authority, (iv) any consequence resulting from any action of or failure to act by any person other than HBOPP or its a affiliates under any supply agreement or (v) any other consequence (including, without limitation, than outage or failure of any equipment owned and maintained by HBOPP or its affiliates), resulting from any act of God. Any action of or to act by any governmental authority (whether in its sovereign or contractual capacity) or any other circumstance beyond the reasonable control of HBOPP or its affiliates (including, without limitation, weather, meteorological or astronomical disturbances, earthquake, fire, flood, strikes, labor disputes, war, civil disorder, epidemics, quarantines and embargoes)
22.5 ‘’Hotel’’ shall mean any hotel, motel, lodge, inn or other similar establishment in the territory offering accommodations on a weekly or shorter basis but shall not include institutions.
22.6 ‘’Household’’ shall mean a distinct residential dwelling unit with a unique billing name and address in the territory.
22.7 ‘’Institutions’' shall mean institutions such as college dormitories, hospitals and correctional facilities.
22.8 ‘’IPTV System’’ shall mean a television service delivered over a point-to-point (from head-end to seat top box) television network system comprising of a digital video broadcasting platform compliant with the DVB standard using twisted copper wire as the delivery/transport to homes by means of a closed user group network located in the territory, and received by subscribers through set top boxes (STB)connected to subscribers television receives. For the avoidance of doubt. IPTV system shall exclude any mode of internet delivery.
22.9 ‘’MATV System’’ shall mean a master antenna television system that receives the programming service by satellite, microwave or otherwise, and that is comprised of a network of coaxial or fiber optic cable and other transmission facilities which is used in whole or in part to deliver the programming service to subscribers located in one or more multiple dwelling building such as appeasements and condominium complexes, and to subscribers consisting of commercial establishments such as hotels.
22.10 ‘’MDS System’’ shall mean an analogue single or multiple channel multipoint distribution system originating from a single point or transmission (excluding repeater sites) used in whole or in part for the delivery of the programming service to subscribers.
22.11 ‘’MDU Subscriber’’ shall mean a household subscriber that receives the programming service through a system located in a multiple dwelling building.
22.12 ‘’Multiple Dwelling Building’’ shall mean a building located within the territory that is comprised of at least ten (10) individual dwelling units that are able to receive video programming through a system.
22.13 ‘’Non-Tiered Service’’ shall mean a service other than a tiered service, or where subscribers are charged on a bulk billing basis.
22.14 ‘’Room’’ shall mean, with respect to a hotel, each private room in such hotel available for temporary or permanent occupancy that contains sleeping accommodation.
22.15 ‘’STV System’’ shall mean a subscription television system that is used in whole or in part to deliver video programming to subscribers by means of a standard UHF or VHF broadcast television signal that its encoded or scrambled by device attached to the subscribers television receiver.
22.16 ‘’Sub licensee’’ shall mean any third party distributor that is in compliance with the standard terms and conditions, as and to the extent applicable to ‘’sub licensees’’, to whom the company has, pursuant to a sub licensee agreement, sub licensed the distribution of the programming service within the territory.
22.17 ‘’Tiered Service’’ shall mean (i) a television programming service that its offered on its own to a subscriber for a charge which is separately allocatable, identifiable with or payable for such service (i,e,on an a la crate basis), or (ii) where such service is offered in a package of services, the charge for such package is separately allocatable, identifiable with or payable for such package, and is in addition to a charge separately allocatable, identifiable with or payable for one ore more other packages (i,e,as a buy-through).
