We have been informed that PT. KACINDO DANATYA (Hereinafter called “the Bidder”)has submitted to you its bid dated (hereinafter called “The Bid”) for the execution of ”Administration Services Firm (ASF) for providing Supporting Services to the Regional Facilitation Professional Staff for Region 2” under invitation for Bids No.102/DPPMD.6/DOK/08/2015.(the IFB)

Furthermore, we understand that. according to your condition bids must be supported by a bid guarantee.

At the request of the Bidder, we PT. Asuransi Mitra Maparya Tbk. hereby irrevocably undertake to pay you any sum or sums not exceeding in total amount of Rp.666.000.000 (Six hundred and sixty six million rupiahs) upon receipt by us of your first demand in waiting accompanied by a writing statement stating that the bidder is in breach of its obligation (s) under the bid conditions, because the bidder:

( a) Has withdrawn its Bid during the period of bid validity specified by the bidder in the form of Bid.
(b) Having been notified of the acceptance of its Bid by the purchaser during the period of bid validity, (i) fails or refuses to execute the Contract Form; or(ii) fails or refuses to furnish the Performance Bond, if reuiredm in accordance with the instruction to Bidders.

This guarantee will expire : (a) if the bidder is the successful Bidder, upon our receipt of copies of the contract signed by the bidder and the Performance Bond issued to you upon the instruction of the bidder; or (b) if the bidder is not the successful Bidder, upon the earlier of (i) our receipt of a copy of your notification to the Bidder of the name of the successful bidder, or (ii) twenty eight days after the expiration of the Bidder’s Bid, Bid Bond shall remain valid for 28 days after bid submission deadline, i.e, bid security shall be valid up to and including January 18,2016.
Consequently, any demand for payment under this guarantee must be received by us at the office an or before that date.
All Claims made by Company under this Bid Bond must be submitted to us at our office not later than one (1) months after the maturity of this Bond.
With reference to article 1832 of the Indonesia Civil Code, Surety hereby waves its privileges to claim that properties of Contractor be first confircated and sold for setting its debts as stipulated under article 1831 of the Indonesia Civil Code.

KACINDO DANATYA (Selanjutnya disebut "Peserta Lelang") telah disampaikan kepada Anda penawarannya tanggal (selanjutnya disebut "The Bid") untuk pelaksanaan "Layanan Administrasi Badan (ASF) untuk menyediakan Layanan Pendukung ke Fasilitasi Regional Staf Profesional untuk Region 2" di bawah undangan untuk Tawaran No.102 / DPPMD.6 / DOK / 08/2015 (yang IFB). Selanjutnya, kami memahami bahwa. menurut tawaran kondisi Anda harus didukung oleh jaminan penawaran. Atas permintaan Peserta Lelang, kami PT. Asuransi Mitra Maparya Tbk. dengan ini tidak dapat ditarik kembali berjanji untuk membayar Anda setiap jumlah atau jumlah yang tidak melebihi jumlah total Rp.666.000.000 (Enam ratus enam puluh enam juta rupiah) pada saat diterima oleh kita dari permintaan pertama Anda di menunggu disertai dengan pernyataan tertulis yang menyatakan bahwa penawar adalah melanggar kewajibannya (s) di bawah kondisi tawaran, karena penawar: (a) telah ditarik nya Bid selama masa berlaku penawaran ditentukan oleh penawar dalam bentuk Bid. (b) Setelah diberitahu tentang penerimaan Bid yang oleh pembeli selama masa berlaku penawaran, (i) gagal atau menolak untuk mengeksekusi Formulir Kontrak; atau (ii) gagal atau menolak untuk memberikan Performance Bond, jika reuiredm sesuai dengan instruksi untuk Peserta Lelang. Jaminan ini akan berakhir: (a) jika penawar adalah Penawar sukses, setelah menerima kami salinan kontrak ditandatangani oleh penawar dan Performance Bond yang diterbitkan kepada Anda setelah instruksi dari penawar; atau (b) jika penawar tidak Peserta Lelang yang sukses, pada awal (i) kami menerima salinan pemberitahuan Anda ke Penawar dari nama pemenang, atau (ii) Dua Puluh Delapan hari setelah berakhirnya Peserta Lelang yang Bid, Bid Bond tetap berlaku selama 28 hari setelah batas waktu pengajuan penawaran, yaitu, Jaminan Penawaran berlaku sampai dengan Januari 18,2016. Akibatnya, setiap permintaan untuk pembayaran di bawah jaminan ini harus diterima oleh kami di kantor satu atau sebelum tanggal tersebut. Semua Klaim yang dibuat oleh Perusahaan di bawah Obligasi Bid ini harus disampaikan kepada kami di kantor kami tidak lebih dari satu (1) bulan setelah jatuh tempo obligasi ini. Dengan mengacu pada pasal 1832 KUHPerdata Indonesia, Surety dengan ini gelombang hak untuk mengklaim bahwa sifat dari Kontraktor harus pertama confircated dan dijual untuk pengaturan utang sebagaimana diatur dalam pasal 1831 KUHPerdata Indonesia.
